About These Terms
Please read carefully before using Mvungi
These Terms of Service and Privacy Policy govern your use of the Mvungi platform (the "Service"), operated by Mvungi Masters (Trading Name: Mvungi Job Masters, Registration Number: BRN-M7SRLJG, "we," "us," or "our"), based in Blantyre, Malawi.

1. General Terms of Service
Applies to all users of the platform
1.1 Acceptance & Updates
These Terms constitute a legally binding agreement. We may update them at any time; continued use after changes constitutes acceptance. We will notify registered users of material changes by email.
1.2 Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to register for or use this Service. By creating an account, you confirm you meet this requirement.
1.3 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized access or breach.
1.4 Prohibited Activities
- Violating any applicable laws or regulations (including Malawian law)
- Providing false, misleading, or fraudulent information
- Harassing, threatening, or discriminating against any person
- Uploading malicious software, spam, or unauthorized advertising
- Attempting to reverse-engineer, overload, or interfere with the Service
- Creating multiple accounts or impersonating another person or entity
1.5 Termination
We may suspend or terminate any account at any time, with or without cause or prior notice, for violations of these Terms or behaviour we deem harmful to the platform or its users.
1.6 Limitation of Liability
To the fullest extent permitted by law, Mvungi Masters shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you to us in the six months preceding the claim.
1.7 Governing Law & Disputes
These Terms are governed by the laws of the Republic of Malawi. Any disputes shall first be attempted to be resolved amicably. Unresolved disputes shall be submitted to the courts of Blantyre, Malawi.
2. Terms for Job Seekers
Individuals using Mvungi to find employment
2.1 Services Provided
- AI-powered profile assessment and job matching
- Automated generation of tailored CVs and cover letters
- Automated submission of job applications on your behalf
- Career tools: skill-gap analysis, interview preparation, CV optimization
- Internship and volunteer placement services
2.2 Your Authorization
By using the Service, you explicitly authorize Mvungi and its AI systems to:
- Process and analyze your profile, CV, and application history
- Generate and customize CVs and cover letters on your behalf
- Automatically submit applications to matched employers
- Share your profile and application materials with relevant employers
2.3 Your Responsibilities
- Provide accurate, truthful, and up-to-date information in your profile
- Review AI-generated materials before they are submitted where possible
- You remain ultimately responsible for the accuracy of all submitted materials
- Notify us promptly if you accept a job offer so we can pause applications
3. Terms for Consultants
Individual consultants and consulting companies on Mvungi
3.1 Who This Applies To
These terms apply to all registered consultants on the Mvungi platform, whether registered as an Individual Consultant or as a Consulting Company.
3.2 Consultant Registration & Verification
- You must provide accurate registration details including full name, email address, and (for companies) your registered company name
- Mvungi reserves the right to verify consultant credentials and may request supporting documentation
- Unverified accounts may have limited visibility or functionality on the platform
- Providing false credentials is grounds for immediate permanent removal
3.3 Services Accessible to Consultants
- A public-facing consultant profile visible to employers and organizations on the platform
- Access to the Mvungi consultant dashboard to manage profile, availability, and engagements
- Ability to receive consultation requests and connect with prospective clients through the platform
- Tools to showcase expertise, set availability, and specify service areas and daily rates
3.4 Consultant Conduct & Professional Standards
- You must maintain professional standards in all interactions conducted through or facilitated by Mvungi
- You may not solicit clients from the platform to conduct business entirely outside of it in order to circumvent Mvungi's role
- You are responsible for ensuring your services comply with all applicable professional licensing and regulatory requirements in Malawi
- You must not misrepresent your qualifications, certifications, or past experience
- Consultants must not discriminate against clients on the basis of gender, ethnicity, religion, disability, or any other protected characteristic
3.5 Engagements & Payment
- Mvungi facilitates connections between consultants and clients but is not a party to any consulting contract or engagement
- All commercial terms (rates, scope, deliverables) are agreed directly between consultants and clients
- Mvungi does not guarantee any minimum level of engagements or income
- Any fees charged by Mvungi for premium features will be disclosed transparently before purchase
3.6 Company Consultants — Additional Terms
- The individual registering on behalf of a company warrants that they have legal authority to bind the company to these Terms
- The registered company name must match the entity's official registration documents
- Companies may list multiple consultants under their profile; each listed individual is bound by these Terms
- Mvungi may request proof of company registration (e.g., Companies Registry certificate) at any time
3.7 Profile Removal & Suspension
Mvungi reserves the right to remove or suspend a consultant profile for violations of these Terms, complaints from clients, or where we determine the profile is misleading or harmful to users of the platform.
4. Terms for Employers
Organizations posting jobs or hiring through Mvungi
4.1 Employer Services
- Free HR dashboard to post job vacancies and manage the recruitment pipeline
- Access to a pool of AI-matched candidates based on your job requirements
- Tools to review applicant profiles, CVs, and shortlist candidates
- Ability to search and engage consultants listed on the Mvungi marketplace
- Analytics and reporting on your recruitment activity
4.2 Job Posting Requirements
- All job postings must be genuine, active vacancies at the time of posting
- Postings must not be discriminatory, misleading, illegal, or in violation of Malawian employment law
- You must remove or mark closed any position that has been filled or cancelled
- Ghost postings (postings with no genuine intent to hire) are strictly prohibited and will result in account suspension
- Job descriptions must accurately represent the role, compensation (where required by law), and working conditions
4.3 Candidate Data & Use
- Candidate profiles and application materials shared with you are provided solely for the purpose of evaluating candidates for the advertised role
- You may not use candidate data for any other commercial purpose, marketing, or unsolicited communication
- You must handle all candidate data in accordance with applicable data protection principles
- Candidate data must not be shared with third parties outside of your normal recruitment process without the candidate's consent
4.4 Engaging Consultants
- When contacting consultants through Mvungi, you agree that initial engagement must occur through the platform
- Employers must not attempt to bypass the platform to avoid any applicable platform fees
- All engagements with consultants are governed by direct contracts between the employer and consultant; Mvungi is not a party to those contracts
4.5 Employer Warranties
By posting on Mvungi, you represent and warrant that:
- Your organisation is a legitimate, lawfully operating entity
- You have authority to recruit for the posted roles
- Your recruitment practices comply with the Employment Act (Cap. 55:02) of Malawi and all other applicable laws
- You will treat all applicants fairly, respectfully, and without unlawful discrimination
4.6 Account Suspension
Mvungi reserves the right to suspend or permanently remove employer accounts for violations of these Terms, reports of misconduct, fraudulent postings, or misuse of candidate data, without liability to the employer.
5. AI Usage & Automated Features
How our AI systems work and their limitations
5.1 What Our AI Does
- Analyses user profiles to identify suitable job matches and consultants
- Generates tailored CV and cover letter content for job seekers
- Automates application submission on behalf of job seekers (with prior authorization)
- Provides career recommendations and skill-gap analysis
- Powers search and matching between employers and candidates/consultants
5.2 AI Limitations & Disclaimer
While we continuously improve our AI systems, you acknowledge that:
- AI-generated content (CVs, cover letters, matches) may contain errors or omissions
- Matching results are probabilistic and not guaranteed to be optimal
- AI systems may reflect biases present in training data; we actively work to mitigate this
- You remain responsible for any content submitted on your behalf through the platform
5.3 Human Review
We encourage all users to review AI-generated materials before they are used. Job seekers can access their generated CV and application drafts from their dashboard before submission.
6. Intellectual Property & Content
Ownership of content on the platform
6.1 Platform IP
The Mvungi platform, its design, branding, code, and original content are owned by Mvungi Masters. You may not copy, reproduce, or distribute any part of the platform without prior written consent.
6.2 User Content License
By uploading or submitting content (CVs, profiles, job postings, etc.), you grant Mvungi Masters a worldwide, royalty-free, non-exclusive license to use, store, modify, and process that content solely for the purpose of delivering and improving the Service.
6.3 Your Ownership
You retain ownership of all content you upload. The license above does not transfer ownership. You may request deletion of your data at any time (see Privacy Rights section).
7. Privacy Policy — Data We Collect

7.2 Automatically Collected Data
- IP address, browser type and version, device type
- Pages visited, features used, and time spent on the platform
- Referral source and session duration
7.3 Sensitive Data
We do not intentionally request sensitive personal data (e.g., race, ethnicity, religion, health information, political views). If you voluntarily include such information in your CV or profile, it is processed only to the extent necessary to deliver the Service. You may remove it at any time.

9. Sharing & Disclosure
Who we share your information with
9.1 With Employers
Job seeker profiles, CVs, and generated application materials are shared with employers when we submit applications on their behalf, or when an employer searches for matched candidates. Consultant profiles are visible to employers searching for expertise.
9.2 With Service Providers
We share data with trusted third-party providers who help us operate the platform, including cloud hosting, analytics, email delivery, and payment processors. All providers are bound by strict confidentiality and data processing agreements.
9.3 With Third-Party Career Service Providers
Only when you explicitly request premium features (such as professional CV redesign or advanced career coaching) will relevant portions of your data be shared with selected partners — solely to deliver that requested service.
9.4 Legal Requirements
We may disclose your information where required by law, court order, or to protect the rights, property, or safety of Mvungi, our users, or the public.
10. Your Data Rights & Security
Control over your personal information
10.1 Your Rights
- Access: Request a copy of the personal data we hold about you
- Correction: Request correction of inaccurate or incomplete data
- Deletion: Request deletion of your account and associated data
- Restriction: Request that we restrict processing of your data in certain circumstances
- Withdrawal of consent: Withdraw consent for optional processing at any time
- Portability: Request your data in a structured, machine-readable format

10.2 Data Security
- All data is encrypted in transit (HTTPS/TLS) and at rest
- Access to personal data is restricted to authorized personnel only
- We conduct regular security reviews and vulnerability assessments
- In the event of a data breach, we will notify affected users and relevant authorities as required by law
10.3 Data Retention
We retain your personal data only for as long as your account is active or as necessary to provide the Service and fulfil legal obligations. You may request deletion at any time; we will complete deletion within 30 days, except where retention is required by law.
10.4 Children's Privacy
The Service is not intended for individuals under 16 years of age. We do not knowingly collect personal data from children. If you believe a child has registered, please contact us immediately.
10.5 International Data Transfers
Your data is primarily processed in Malawi. Where we use service providers based in other countries, we ensure appropriate safeguards are in place, including contractual data protection clauses.
